INTELLIMED offers on its website eChlorial.fr and its subdomain (.com , .de.com, .es, etc), free information, as well as a selection of products. The conditions of the offer, sale and delivery of the products are detailed below.

INTELLIMED has declared its customer and prospect files to the Commission Nationale de l'Informatique et des Libertés (CNIL) in accordance with the simplified standard. Its registration number is: 1173061.

Any person using the INTELLIMED site or/and placing an order with INTELLIMED acknowledges having read the following terms and conditions and declares accepting them without reservation.

The Intellimed company's products are microalgae or microalgae-based (chlorella, spirulina) which are part of the positive list of foods authorized for human and animal consumption by the European and French authorities (ANSES). They are foods that can be sold as food supplements*.

The consumer is solely responsible for the proper use and consumption of Intellimed's food products. The Intellimed company undertakes to supply quality-controlled products, whose compositions are within the average values specified in the technical specifications. The company is not responsible for damage caused by misuse or improper storage. The company cannot be held responsible for any lack of performance expected by the consumer, it being understood that, as natural products, the expected effects are totally dependent on the conditions of use and the consumers themselves.

Microalgae or microalgae-based products are natural products and therefore by definition unique. Slight changes in color and odor may be observed between different batches of products, even if they always possess a composition in line with the average values specified.

As such they may not be used, other than for private use, without prior authorization obtained in writing.

The user agrees not to copy, without the written consent of INTELLIMED, all or part of the site on another site or network for private or professional purposes.
Any creation of a hypertext link from an Internet site to the INTELLIMED site must obtain prior written authorization.

4. Confidentiality and personal data

In accordance with the provisions of Law no. 78-17 of January 6, 1978 relating to information technology, files and freedoms, the site has been declared to the CNIL (Commission Nationale Informatique et Liberté).
According to Article 34 of the French Data Protection Act of January 6, 1978, users and customers of the site who have provided personal information via the site have the right to access, modify and delete any data concerning them. To exercise this right, simply send your request by e-mail or post to the site manager.

INTELLIMED undertakes to treat all data collected on the site as confidential.

The data provided by customers is used to process their orders and to personalize the communication reserved for them, in particular through newsletters.

5. Moderation: comments and testimonials

Personal questions will be answered confidentially by email. For these requests, please use the contact form.

To be validated and circulated widely, your suggestion must be written intelligibly and correctly. Writing of a polemical or disrespectful nature will be discarded.

The information communicated must be of interest to the majority of consumers or future consumers. Its aim is to share knowledge with a view to finding suitable, optimal use for better well-being. The information may reflect positive or negative experiences encountered during product consumption. They can also provide additional data on the subject evoked on the page.

Terms and conditions of sale

1. Purpose

The purpose of this agreement is to provide for the conditions of sale and delivery of the products (the Products) offered for sale, on the website eChlorial, by the company INTELLIMED.
The placing of an order by the Customer on the site, by telephone, by mail or by fax, implies acceptance by the latter, without reservation, of these General Terms and Conditions of Sale, as well as the General Terms and Conditions of Use of the site.

2. Products and availability

Product offers and prices are valid as long as they are visible on the site, and within the limits of available stocks.
In the event of stock shortage, the customer will be informed without delay. He/she will be asked to confirm the continuation of his/her order.

3. Ordering

The customer may freely place an order on the site. He can create his customer account free of charge, which will save him time for subsequent purchases.

When creating his account, the customer agrees to provide accurate and sincere information about his situation.

The creation of a customer account gives rise to the allocation of a confidential identifier and password, enabling the customer to access his private interface for managing data concerning him.
These identification elements are personal, confidential and non-transferable. Under these conditions, the customer undertakes not to communicate them to third parties.
INTELLIMED cannot, in any event, be held responsible for fraudulent intrusion on the customer's private interface while using the services.
These identification elements can be modified online by the customer in his private area. INTELLIMED reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

4. Financial conditions

PRIX
Product prices are displayed all taxes included, excluding packaging and shipping costs.
They apply inclusive of all taxes to all Customers located in metropolitan France, and in an EU country.
For Customers located outside France or the EU, the amount of the order is invoiced exclusive of tax, i.e. with a reduction of VAT at the rate in force in France for the products concerned. In this case, however, it is the customer's responsibility to check whether any taxes or customs duties are due in their own country.

INTELLIMED reserves the right to modify its prices at any time, but Products will be invoiced on the basis of the rates in force at the time orders are recorded, subject to availability on that date.

PAYMENT
Orders are payable exclusively in Euros, exclusively in £ in the UK and exclusively in $ in the USA.

Payment for orders is made:

- either online by credit card: CB, Visa, Mastercard

INTELLIMED guarantees the security and confidentiality of customer data relating to online credit card payment on the site.
INTELLIMED uses the services of LA BANQUE POSTALE via its SCELLIUS 3D Secure system for secure online payment. Customers' bank details are encrypted and transmitted directly to the bank, without passing through the INTELLIMED site.

These data are however accessible by INTELLIMED in the event that the customer wishes to pay for his order without going through the site, i.e. by mail, fax or telephone.

INTELLIMED undertakes to keep all bank details strictly confidential.

INTELLIMED draws attention to the risks incurred by its customers who use other means of payment. The communication of unencrypted data does not guarantee confidentiality.
Only CB, Visa and Mastercard cards are accepted.

Payment by bank check is reserved for holders of a bank account in Euros domiciled in France.

Validation of the order by the Customer implies the Customer's acceptance, without reservation, of these General Terms and Conditions of Sale.

5. General conditions of retraction

In accordance with current regulations, article L.221-18 of the French Consumer Code, a customer has a right of withdrawal of 14 working days for any purchase concluded remotely. This period runs from the day of receipt of the product(s) ordered.

The customer may exercise his right of withdrawal by sending an e-mail to contact@echlorial.fr or a simple letter to the company's customer service department or a registered letter to the company INTELLIMED 69 rue d'Alep 38080 L'Isle d'Abeau. The company will acknowledge receipt.
If the order is retracted before it is dispatched, payment may be cancelled immediately online, and the customer will be informed.

Returned products must not have been opened, and the tamper-evident seal on the jar must be intact. They must be well packaged to be received in perfect condition. For reasons of hygiene, products returned, opened or damaged will not be taken back.

The customer is responsible for return shipping costs (shipping costs + costs of logistical processing of the return package).

If the returned products are deemed to be in conformity, the order will be reimbursed, minus the return costs, as soon as possible, at the latest under the conditions defined by law (article L.221-19 of the French Consumer Code). The refund will be made by bank transfer or cheque.

6. Delivery

Modalities

Products are shipped by Carrier, according to the choice made at the time of ordering. Details on costs, estimated delivery times and delivery conditions are specified at the time of ordering to facilitate choice.

Products are dispatched as soon as possible after acknowledgement of receipt of the order for payment by credit card, or on receipt of the cheque or bank transfer for this method of payment.

Complaints

In the case where the choice of a delivery method without signature has been made, when it was offered at the time of ordering, no compensation is possible if the carrier confirms the delivery of the package on the tracking of the latter.

In the event that a package arrives damaged at the customer's home due to transport, depending on its condition, the customer may refuse it to the carrier. The customer is advised to take photos of the damaged package. The customer will keep the company informed, if possible sending photos that will enable the company to make claims with the carrier.

The INTELLIMED company undertakes to reimburse the Customer, or to exchange the damaged package, which will be returned by the Customer or the carrier.

In the event that the parcel arrives after having been opened by customs (for control), the parcel will neither be reimbursed nor returned, insofar as the customs service has the right to open all parcels. The latter guarantees that the opening is carried out with care and cleanliness, considering that these are food products.

7. Liability

Product information originates exclusively from data provided by the manufacturer.
The products offered comply with current EU legislation and standards applicable in France.

The photographs and graphics illustrating the products presented are given for information only.

INTELLIMED shall not be held liable for non-performance of the contract in the event of force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood, fire...

8. Warranty

The company undertakes to comply with its obligations relating to the warranties attached to its products, particularly in the case of defects in conformity of the goods with the contract under the conditions of article L. 217-4 et seq. of the French Consumer Code and hidden defects in the product under the conditions provided for in articles 1641 et seq. of the French Civil Code.

Thus, in the event of product non-conformity, the customer, in accordance with the provisions of Article 217-9 of the French Consumer Code, has twenty-four months from receipt to request replacement of the non-conforming product. The customer may also request a credit note or have all or part of the price refunded, in accordance with the provisions of article 217-10 of the French Consumer Code.

The preceding provisions are not exclusive of the application of the legal warranty for hidden defects under articles 1641 et seq. of the French Civil Code, in accordance with the provisions of article L. 211- 9 of the French Consumer Code.

As these are consumable and perishable products, storage conditions are defined (duration, temperature, humidity, light). The company reserves the right to carry out analyses of products received back in order to verify their conformity to specifications. The results will take into account the best-before date (BBD) and any deterioration that may be linked to poor product storage conditions.

9. Miscellaneous

INTELLIMED reserves the right to unilaterally modify the terms of these conditions.

The new clauses will govern all relations between the Parties for the future, and only the latest online version of INTELLIMED's General Terms and Conditions of Sale will prevail.

10. Applicable law in the event of disputes

The present contract is subject to French law.
